REGULATIONS

Regulations are written and managed by regulatory bodies covering different sectors of health and social care. They are usually linked to an existing piece of legislation and aim to give employees formal guidelines for carrying out their duties effectively.

Regulations ensure that the employee is fit to practice and that vulnerable individuals are safe in their care.

Examples of regulatory bodies and their regulations include:

  • The General Medical Council – Good Medical Practice
  • Nursing and Midwifery Council – The Code
  • Health and Care Professionals Council – Standards.
CODES OF PRACTICE

Codes of practice are formal national guidance to ensure that individuals needing care and support across Wales can be guaranteed the same level of care.

Examples of these are:

  • NHS Wales Code of Conduct for Healthcare Support Workers in Wales
  • Code of Practice for NHS Wales Employers
  • Code of Professional Practice for Social Care
  • The Residential Child Care Worker – practice guidance.

Good medical practice

All medical doctors need a license to practice in Wales. This license needs to be revalidated every five years, and in order to gain revalidation a doctor must prove:

  • they are keeping their knowledge up to date
  • they are fit to practice, and no concerns have been raised about them
  • they provide a good level of care.

In order to ensure that doctors understand what is expected of them, the General Medical Council has a code of ethical practice (Good Medical Practice) that sets out what it means to be a good doctor.

The document is split into four parts:

  1. Knowledge skills and performance
  2. Safety and quality
  3. Communication, partnership and teamwork
  4. Maintaining trust.

The Code

Nurse

The Code outlines the professional standards that nurses, midwives and nursing associates must uphold in order to be registered to practice in the UK.

It plays a central role in the nursing and midwifery professions and encourages nurses and midwives to consider how it applies in their everyday practice.

Nurses need to revalidate their licence to practice every three years, and in order to do this it is recommended that they use the Code as the reference point for all the requirements, including their written reflective accounts and reflective discussion.

The Code is split into four parts:

  1. Prioritise people
  2. Practice effectively
  3. Preserve safety
  4. Promote professionalism and trust.

Health and Care Professionals Standards

Safonau Gweithwyr Iechyd a Gofal Proffesiynol

The Health and Care Professions Council is the regulatory body for health, social work and psychological professions.

The professions they regulate have one or more designated titles that are protected by law and professionals must be registered to use them.

These are:

  • Arts therapist
  • Biolomedical scientist
  • Chiropodist/Podiatrist
  • Clinical scientist
  • Dietician
  • Hearing aid dispensers
  • Occupational therapist
  • Paramedic
  • Physiotherapist
  • Practitioner psychologist
  • Prosthetists/Orthotists
  • Radiographers
  • Speech and language therapists.

There are four standards that individuals working in these professions must meet:

  1. Standards of conduct, performance and ethics
  2. Standards of proficiency
  3. Standards of continuing professional development
  4. Standards relevant to education and training.

NHS Wales Code of Conduct for Healthcare Support Workers in Wales

This Code applies to all healthcare support workers employed in clinical and non-clinical environments within NHS Wales.

It sets out the standards that Healthcare Support Workers are expected to meet.

This Code is based on the basic principle of protecting the public and provides an assurance framework so that the public can understand what standards they can expect of healthcare support workers.

The standards are split into seven sections:

  1. Be accountable by making sure you can always answer for your actions or omissions.
  2. Promote and uphold the privacy, dignity, rights and well-being of service users and their carers at all times.
  3. Work in collaboration with your colleagues as part of a team to ensure the delivery of high quality safe care to service users and their families.
  4. Communicate in an open, transparent and effective way to promote the well-being of service users and carers.
  5. Respect a person’s right to confidentiality, protecting and upholding their privacy.
  6. Improve the quality of care to service users by updating your knowledge, skills and experience through personal and professional development.
  7. To promote equality; all service users, colleagues and members of the public are entitled to be treated fairly and without bias.

The Code of Practice for NHS Wales’ employers is an important assurance mechanism, supporting the employment of Healthcare Support Workers in Wales.

It supports the basic principles of service user safety and public protection and underpins the day-to-day working practices of NHS Wales.

Employers need to establish and implement systems and processes to support healthcare support workers to achieve the standards in their Code of Conduct.

In addition, employers need to use the workplace as an opportunity to develop healthcare support workers by providing more fulfilling working conditions that help staff carry out their roles effectively, whilst preparing them to progress to new and extended roles in the future.

The Code of Practice is split into four sections:

  1. Make sure people are suitable to be employed within the healthcare workforce, and that they understand their roles, accountabilities and responsibilities.
  2. Have procedures in place so Healthcare Support Workers can meet the requirements of the Code of Conduct.
  3. Provide timely, appropriate and accessible education, training and development opportunities to enable Healthcare Support Workers to develop and strengthen their skills and knowledge.
  4. Promote this Code of Practice and the Code of Conduct for Healthcare Support Workers to staff, service users and other stakeholders and ensure its use in day-to-day practice within your organisation.

Code of practice

The Code of Professional Practice for Social Care is a list of statements that describe the standards of professional conduct and practice required of those employed in the social care profession in Wales.

The Code plays a key part in raising awareness of these standards.

There are seven sections to the Code.

As a social care worker, you must:

  1. Respect the views and wishes, and promote the rights and interests, of individuals and carers.
  2. Strive to establish and maintain the trust and confidence of individuals and carers.
  3. Promote the well-being, voice and control of individuals and carers while supporting them to stay safe.
  4. Respect the rights of individuals while seeking to ensure that their behaviour does not harm themselves or other people.
  5. Act with integrity and uphold public trust and confidence in the social care profession.
  6. Be accountable for the quality of your work and take responsibility for maintaining and developing knowledge and skills.
  7. In addition to sections 1 – 6, if you are responsible for managing or leading staff, you must embed the Code in their work.

The Residential Child Care Worker – practice guidance

Support group

This guidance is for residential childcare workers registered with Social Care Wales; it builds on the Code of Professional Practice for Social Care and aims to:

  • describe what is expected of workers
  • support workers to deliver a good service.

It is based on relevant national occupational standards, the views of children and young people and other stakeholders.

There are eight sections to the guide:

  1. Child-centred care and support
  2. Good residential childcare practice
  3. Safeguarding individuals
  4. Health and Safety
  5. Developing yourself
  6. Contributing to the development of others
  7. Contributing to the service
